FUJITSU RAPID REWARDS PROGRAM (EXTENSION) AUSTRALIA
TERMS AND CONDITIONS
By participating in the Fujitsu General Australia “Fujitsu Rapid Rewards Program campaign” (the “Campaign”) the Claimant is agreeing to the following terms and conditions:
ELIGIBILITY CONDITIONS
1. The Campaign is only open to Australian residents aged 18 years or older who:
a. Purchase an Eligible Product (defined below) from any of the following wholesalers:
i. Blue Star (Blue Star Air Conditioning);
ii. ACD (ACD Trade. ACD/ACD Trade in WA is specifically excluded from this Campaign);
iii. HVAC Consolidated AAD (Australian Airconditioning Distributors);
iv. Reece (Metalflex);
v. Mannix (Air Conditioning Warehouse Sales); or
vi. HCSA Group Pty. Ltd. (AirConditioning Equipment).
b. Are ABN holders;
c. Are accredited installers with an appropriate Refrigerant Handling Licence (ARCTick) (RHL) licence to install air-conditioning systems to residential or commercial application;
d. Are Claimants that have registered to participate in this Campaign; and
e. Have purchased an Eligible Product from a participating Fujitsu Wholesaler, then sold and installed this Product to an end user.
2. The following people are excluded from entering into the campaign:
a. Anyone that does not meet the criteria in clause 1 or that is not a “Claimant”;
b. Management, employees, current credit account holders with the Promoter, directors and contractors of the Promoter, its related entities and other agencies, firms or companies associated with the Campaign (for the avoidance of doubt, current credit account holders with the Promoter are excluded from entering this Campaign);
c. The immediate family of any persons listed in clause 2 (a) and (b), which means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin
d. For the avoidance of doubt, sub-contractors of retailers are ineligible to participate in the Campaign.
3. For Claimants to become entitled to receive a Reward the following must occur:
a. Claimants must confirm existing membership on-line or register on-line to the Fujitsu Rapid Rewards Program during the Purchase & Installation Period. This can be done by visiting the website www.fujitsugeneral.com.au/rapidrewards and following the link to the Rapid Rewards login page confirming existing details or completing and submitting the registration form.
b. Claimants must submit all reasonable information required by the Promoter, including but not limited to, name, address, business name, ABN and Refrigerant Handling Licence (RHL) ARCTick number.
c. Claimants must then agree to the terms and conditions set out on the website. EachClaimant can only register once to be eligible for the Rapid Rewards program.
d. Claimants must purchase any Eligible Product from a participating Fujitsu Wholesaler during the promotional purchase period.
e. Claimants must then onsell and install any Eligible Product to their customer/end user. The customer/end user must purchase and have the Eligible Product installed by the Claimant during the specified Purchase & Installation Period.
f. Claimants may only claim Rewards by registering a purchase and installation via the on-line claim form in accordance with clause 8 in respect of the Eligible Products purchased (“Claim Form”).
4. The Claim Form must be fully completed by the Claimant and received by the Promoter prior to the Final Claim By Date in order to receive the relevant Reward.
5. The maximum number of Eligible Products that can be claimed on one claim is six (6).
6. By participating in this Campaign, the Claimant agrees to provide:
a. All details requested by the Promoter, including but not limited to, the Claimant's first name, surname, contact phone number, postal address, email address;
b. ABN;
c. Refrigerant Handling Licence (RHL) ARCtick number;
d. Valid outdoor model and serial number;
e. Valid indoor model and serial number for eligible combinations as set out in the Schedule;
f. Proof of purchase from participating Fujitsu Wholesaler; and
g. The installation address post code.
7. All communications between a Claimant and the Promoter will be managed through the website and via email unless the Promoter, in its complete discretion decides otherwise.
REGISTERING A CLAIM
8. Claimants must visit www.fujitsugeneral.com.au/rapidrewards to register a consumer sale, follow the links to the Claim Form and complete and submit the Claim Form by:
a. Submitting all details as required by the Promoter, including but not limited to, Eligible Product details including model and outdoor unit serial numbers, installation post code, purchase date, installation date and upload a copy of the consumer tax invoice.
9. All OUTDOOR SERIAL NUMBERS on all units and INDOOR SERIAL NUMBERS on selected units will be validated against the Promoter's company records. If the serial number does not match, a further investigation will take place. A Claimant may be required to submit further documentation to validate these serial numbers (i.e. photo of the compliance plate). Accordingly, the Claimant should take a picture of the compliance plate upon installation of the Eligible Product. Photographs of the boxes or packaging materials as proof of purchase will not be accepted. A physical image of the unit and the serial number is required.
10. If the serial number has already been claimed by another Claimant, or individual in the same or another one of the Promoter’s campaigns, both claims will be under investigation by the Promoter.
11. All Claimants must retain a copy of their supplier invoice and end user tax invoice for all claims as proof of purchase and/or installation. Failure to produce the proof of purchase and/or installation for all claims when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL claims and forfeiture of any right to a Reward. Supplier and end user taxinvoices must clearly specify the model and serial number of the Eligible Product.
12. The Promoter may also request the Claimant to provide the INDOOR SERIAL NUMBER for validation to ensure that the indoor unit corresponds to the appropriate outdoor unit as listed in the Eligible Product List. In the event that the indoor unit does not correspond to the relevant outdoor unit in the Eligible Product List, the unit combination is not an Eligible Product and therefore the claim will be deemed invalid.
NOTE: END USER / CONSUMER PERSONAL DETAILS EXCEPT POSTCODE MUST BE BLACKED OUT. FAILURE TO BLACK OUT CUSTOMER PERSONAL DETAILS WILL DEEM THE CLAIM INVALID.
13. Each end user sale can only be registered once. Any end user / consumer sale registered more than once will be deemed invalid.
14. All Claim Forms must be received by the Promoter by the end of the Final Claim By Date. Claim Forms are deemed to have been received at the time of receipt into the database and not at the time of transmission by the Claimant.
15. Once submitted, Claimants cannot change, alter or delete their Claim Form.
16. Incomplete and ineligible Claim Forms will be deemed invalid. Claim Forms will also be deemed invalid if they breach these Terms and Conditions as determined by the Promoter in its absolute discretion or any other instructions or guidelines notified by the Promoter during the claims process for the Campaign.
17. The Claimant is responsible for all costs associated with entering this Campaign.
18. The Promoter may, at any time, request additional information, including but not limited to photographs of the unit, supplier invoices or proof of purchases to verify each claim.
19. The Claimant must provide the additional documents by the date specified by the Promoter or the claim will be declined.
20. Any claims or invoices supplied outside of the Final Install By Date will automatically be declined.
REWARDS
21. Claimants will receive their Reward as a Vault Pays-enabled Fujitsu Digital Prepaid Reloadable Mastercard® delivered via SMS to the Australian mobile phone number registered with their account. For clarity, a Reward will only be awarded to Claimants who have completed the steps outlined in clause 3. Approved claims can be cashed out at any time via www.fujitsugeneral.com.au/rapidrewards - funds are available within three (3) business days. Failure to cash out before the Final Install By Date will result in the automatic cash out push at the end of the Final Redemption Date for the balance of approved claim(s) against that Claimant.
22. In the case of Claimants who have multiple Eligible Product purchases approved under the one (1) Claim ID, the Promoter reserves the right to load or reload the accumulated value of each Reward they are eligible for on the Vault Pays-enabled Fujitsu Digital Prepaid Reloadable Mastercard, rather than issuing separately per valid Eligible Product purchased.
23. Claimants must allow up to ten (10) business days for validation after submission of a Claim. The Claimant will be sent an email to the email address provided on the Claim Form with notification of Claim approval.
24. The Promoter will not be responsible for any Reward which is lost, late or misdirected including by reason of the misstatement or illegibility of the mobile phone number of the Claimant in theClaim Form forming part of their Claim or the failure of a Claimant to notify the Promoter of a change in mobile phone number. Use of the Reward is subject to all the terms and conditions located at www.vaultps.com.au/terms.
25. The Promoter will not be responsible for any Reward which is lost, late or misdirected including by reason of the misstatement or illegibility of the mobile phone number or delivery address of the Claimant in the Claim Form forming part of their claim or the failure of a Claimant to notify the Promoter of a change in mobile phone number or delivery address of the Claimant. Use of the Reward is subject to all the terms and conditions located at www.vaultps.com.au/terms.
26. Reward values as outlined in the Eligible Product List are for both the purchase and installation of an Eligible Product. For clarity, individuals who install an Eligible Product only will not be eligible to claim a Reward.
27. Vault Payment Solutions (“Vault”) is subject to the AML/CTF Laws (Anti-Money Laundering and Counter-Terrorism Financing Act 2006). If a card has a balance of between $4,999 to $9,999, Vault is obliged to collect and verify certain identification information from the cardholder in compliance with the AML/CTF Laws. Customer identification information includes detailed 'know your customer' (KYC) information about the cardholder such as:
a. Name, and
b. Address, and
c. Date of birth.
28. If EML and Vault are unable to verify a Claimant’s identity using their name, address and/or date of birth, the Claimant may be requested to provide additional information to verify their identity.
29. Vault may be prohibited from offering services or entering into or conducting transactions if this information is not provided. Further, Vault may cancel a card if Claimants do not provide this information.
30. EML and Vault collect and store personal information for the primary purpose of creating and managing a Claimant’s card. As part of this process, EML and Vault will use this information to verify a Claimant’s identity so that EML and Vault can comply with the AML/CTF Laws. EML and Vault may also use personal information to communicate with Claimants and in circumstances where Claimants would reasonably expect such use or disclosure.
31. EML and Vault will only use personal information to:
a. To ensure that the card properly functions with a Claimant’s device;
b. To assist in arrangements with other organisations in relation to the provision of a product or service;
c. To perform administrative and operational tasks (including systems development and testing);
d. To prevent or investigate any fraud or crime (or a suspected fraud or crime); and
e. Satisfy identification requirements under the AML/CTF Laws and such information may be exchanged with verification agencies (which may be overseas). EML and Vault may also exchange information with Pays.
32. Examples of personal information that is collected includes names, addresses, email addresses, and phone numbers. When EML and Vault collect personal information they will, where appropriate and where possible, explain to Claimants why this information is being collected and how it will be used.
REWARD ACTIVATION AND REDEMPTION
33. Redemption of a Reward is subject to the terms and conditions of Vault including activating the Reward before the specified expiry date which will be sent to the Claimant when their Reward activation code is sent by SMS to the mobile phone number they provided when entering the Campaign.
34. Claimants must have a smart phone device that is capable of downloading the Vault Payment App in order to redeem the Reward. For clarity, a physical alternative will not be offered if Claimants do not have a smart phone device or a device that is incapable of accessing the Vault Payments App.
35. The Reward needs to be activated by following the link to access the Vault Payments Application via the App store that is sent in the SMS with their Reward activation code. By clicking on this link in the SMS, the Claimant will automatically download and open the Vault Payments App, entering and validating the Claimant’s mobile number and activation code.
The Claimant is then required to:
a. Create a password (minimum of 6 characters) if they are a first time user of the Vault Payments App.
b. Registered users of Vault Payments App already, enter their existing password, the Claimant may then add the card to the wallet on their phone.
36. Claimants can create a PIN for the Fujitsu Digital Prepaid Reloadable Mastercard® via the Vault Payments App as using the Reward for purchases over $100 may require claim of a PIN. Instructions on how to set up a PIN are found in the “How do I find my pin number?” FAQ located at www.vaultps.com.au/faq/.
37. Reward activation codes expire at 11:59pm AEST/AEDT (as applicable) on the stated expiry date of the activation code. The expiry date provides 3 months in which the Reward activation code must be activated.
38. The Reward is valid until the expiry date shown on the front of the card in the Vault Payments App (not less than thirty-six (36) months from date of production) and cannot be used after expiry.
39. Rewards that are not activated or redeemed within the designated time frame included in the SMS sent with the code cannot be re-activated, extended or refunded in any way. The Promoter is not responsible should the Claimant fail to activate or redeem the Rewards in time.
40. Customer support for the Vault Pays-enabled Fujitsu Digital Prepaid Mastercard is available at www.vaultps.com.au/faq/activate-card/.
FORFEITURE, REPLACEMENT & LIMITATIONS
41. Any unused balance of the Reward as of card expiry date will be forfeited.
42. If a Reward is unavailable, the Promoter, in its discretion, reserves the right to provide a substitute product or item to the equal value and/or specification.
43. The Reward is not transferable or exchangeable and cannot be taken as cash, unless otherwise specified. Any ancillary costs associated with redeeming the Reward are not included.
GENERAL
44. The Promoter is Fujitsu General (Aust.) Pty Limited (ABN 55 001 229 554), 1 Telopea Place, Eastern Creek NSW 2766 (“Promoter”).
45. By participating in this Campaign, the Claimant accepts these Terms and Conditions and agrees to receive correspondence from the Promoter's Agent. The Claimant acknowledges that the Promoter may disclose your personal information to the Promoter's Agent for the purpose of conducting this Campaign.
46. In these Terms and Conditions, the following terms have the following meanings:
a. "Eligible Product(s)" means the Fujitsu General Australia Air-Conditioner products listed in the Eligible Product List and at www.fujitsugeneral.com.au/rapidrewards. Only indoor and outdoor unit combinations as stated in the Eligible Product List are eligible. For clarity, the stock of Eligible Products are subject to availability.
b. "Claimant" means accredited installers that stock or sell Eligible Products and have opted to participate in this Campaign.
c. "Purchase Period" means the period between 8am AEDT on 1 April 2023 and ends at 5pm AEST on 31 March 2024 for all Eligible Products.
d. "Final Install By Date" means 5pm AEST on 30 April 2024. This date may be changed by the Promoter in its absolute discretion.
e. "Final Claim By Date" means 5pm AEST on 31 May 2024.
f. "Final Redemption Date" means 5pm AEST on 30 June 2024.
g. "Reward" means the rewards offered to Claimants for their sale and installation (in dollar value) of Eligible Products as specified in the Eligible Product List and redeemed under in accordance with the “Reward Activation and Redemption” section below. For removal of doubt, AEST or AEDT as specified in the definitions above applies to all Claimants regardless of their city or country of residence. Local time zones are not relevant. Any Eligible Products sold outside of the Purchase Period or installed outside of the Final Install By Date are not eligible for a claim or Reward. Any claims received after the Final Claim By Date will be invalid. Any redemptions received after the Final Redemption Date will not be fulfilled.
47. A Claim Form may be subject to such follow up enquiries or investigations or security and verification checks as the Promoter determines to apply at the absolute discretion of the Promoter. The Claim Form will be ineligible if the Claim Form and/or the original or photocopied proof of purchase (valid tax invoice) and proof of payment is mutilated, illegible, stolen, forged, reconstructed, altered, incomplete or tampered with in any way, or if they fail any of the Promoter’s security and verification checks or if the Promoter in its absolute discretion determines that a Claimant is not an eligible Claimant or the Claim Form does not comply with the Terms and Conditions as outlined, whether as a result of follow up, inquiry or investigation or otherwise.
48. If, for any reason, a Claimant does not take or redeem a Reward at or by the time stipulated by the Promoter, then the Reward will be forfeited.
49. The decision of the Promoter on all matters pertaining to this promotion is final. No correspondence will be entered into.
50. The Promoter accepts no responsibility for any tax implications that may arise from the offer. Independent financial advice should be sought. If for GST purposes this promotion results in any supply being made for non-monetary consideration, Claimants must follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.
51. Nothing in these Terms and Conditions limits, excludes, or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter(including its respective officers, employees, and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special, or consequential, arising in any way out of the promotion.
52. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees, and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special, or consequential, arising in any way out of:
a. Any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
b. Any theft, unauthorised access or third party interference;
c. Any claim or Reward that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
d. Any tax liability incurred by a Claimant; or
e. Use/redemption of a Reward.
53. Retailers/dealers are not authorised to verify, pay or advise about, any claim, the offer, or the promotion.
54. Any cost associated with accessing the promotional website is the Claimant’s responsibility and is dependent on the Internet service provider used. The use of any automated software or any other mechanical or electronic means that allows a Claimant to automatically claim and enter repeatedly is prohibited and will render all claims submitted by that Claimant invalid.
55. All Claimants acknowledge that the Promoter can rely on these Terms and Conditions even if the Promoter only learns of a person’s ineligibility after the Promoter has awarded a Reward to the ineligible person. Payment of the Reward value to the Promoter may be required by the Claimant if this occurs.
56. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law:
a. To disqualify any Claimant; or
b. To modify, suspend, terminate, or cancel the promotion, as appropriate.
57. By submitting a claim in the promotion, Claimant’s consent to the Promoter using their name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
58. The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers and prize suppliers, such as Vault Payment Solutions Group Pty Ltd (ABN 66 632 373 105) and EML Payment Solutions Limited ABN 30 131 436 532. Submitting a claim is conditional on providing this PI. The Promoter will collect, use and disclose such PI as set out in its Privacy Policy, which can be viewed at www.fujitsugeneral.com.au/help-centre/privacy-policy. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages ortelephoning the Claimant. The Privacy Policy also contains information about how Claimants may opt out, access, update or correct their PI, how Claimants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All claims become the property of the Promoter (including any intellectual property rights). This may include disclosures to organisations outside Australia including in places such as Singapore. In addition, where the Vault Payment Solutions Group Pty Ltd or EML Payment Solutions Limited handle PI on behalf of the Promoter, such PI will also be handled in accordance with their respective privacy policies, which can be viewed at www.vaultps.com.au/privacy-policy/ and www.vaultps.com.au/privacy-policy/.
59. As a condition of claiming a Reward, the Claimant may be required to sign any legal documentation as and in the form required by the Promoter and/or Reward suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
60. Any ancillary costs associated with redeeming the Reward are not included. The Reward must be activated within three (3) months of issue and is valid for 36 months after activation. At expiry of the Reward, any unused balance will be forfeited. We will not give you notice prior to expiry. Card expiry and balance can be found on your mobile device in your digital wallet. All Rewards are issued by EML Payment Solutions Limited (ABN 30 131 436 532) (“EML”) AFSL 404131 pursuant to license by Mastercard Asia/Pacific Pte. Ltd. See www.vaultps.com.au/terms for terms and conditions. Mastercard and the circles design are registered trademarks of Mastercard International Incorporated.
